Polk Community College Procedure
Subject Reference Date Number Copyright Law PL 94-553 Title 17, U.S. Code 03/08/78 4004 The Copyright Law PL 94-553 Title 17 U.S. Code effective January 1, 1978, balances the interests of authors and artists with the interests of the user in having access to information. To insure that the College complies with the provision and intent of PL-553 and its guidelines as they are presently understood and interpreted, the following procedure is developed.
1. The Director of Learning Resources will inform staff in writing of major
provisions of the copyright law as they relate to copying for
educational purposes. However, the college employees, except for the
Board Attorney, will not supply legal advice.
2. A complete copy of PL 94-553 and guidelines will be kept on reserve in
the Polk Community College Library (additional information is in the
Faculty Handbook).
3. Notices as specified by the law and the Register of Copyright will be
posted in highly visible locations on or near each duplication machine
on campus (photo-copier, audio duplicator or microform printer)
available to staff in wording as designated for supervised and
unsupervised machines.
4. The college staff and college equipment will not be used to reproduce
copyrighted material outside of fair use limits or limits specified in
section 108 unless written permission from the copyright owner is
received. When such permission is obtained all conditions will be
carefully honored by the college staff.
5. Staff wishing to make copies or have copies made of copyrighted
materials over and above allowances for fair use or other use permitted
by the law and its guidelines, will be responsible for obtaining written
permission from the copyright owner and following the provisions of this
permission, if any.
6. The Director of Learning Resources will adhere to all provisions
specified in the law or the guidelines affecting interlibrary loan and
reserve materials.
